Canada-Chile Free Trade Agreement (CCFTA)

El CCFTA es un acuerdo de libre comercio basado en el Tratado de Libre Comercio de América del Norte (“NAFTA”) . Bajo este programa, los ciudadanos de Chile tienen derecho a solicitar la entrada temporal a Canadá sin la necesidad de obtener una Visa ademas de optar a permisos de trabajo sin el requerimiento de obtener un LMIA. (Para recordar que es un permiso de trabajo, revisa el articulo “Permisos de Trabajo en Canada”).

Los ciudadanos de países no pertenecientes al CCFTA que residen permanentemente o trabajan temporalmente en Chile no son elegibles para los beneficios del CCFTA.

Al igual que el NAFTA, el CCFTA posee 4 categorías de beneficiarios:

  • Viaje de negocios,
  • Transferencia dentro de la compañía
  • Inversionistas y traders.
  • Profesionales y técnicos

Visitantes de negocios

Al igual que con el NAFTA, los visitantes efectuando un viaje de negocios, son personas que buscan una entrada temporal para llevar a cabo las actividades relacionadas con su actividad económica (Visita de clientes y distribuidores, supervisión de subsidiarias, reuniones de negocios, etc).  Los visitantes por negocios no pueden ingresar al mercado laboral local. En otras palabras, la fuente principal de remuneración y el lugar principal de negocios de la persona deben permanecer fuera de Canadá. La intención de la disposición del visitante de negocios es facilitar la entrada a Canadá del visitante de negocios a corto plazo que no tiene intención de ingresar al mercado laboral canadiense. Por lo tanto, el propósito de la entrada del extranjero debe ser de alcance internacional. En otras palabras, el extranjero debe ingresar a Canadá en nombre de una empresa comercial ubicada en Chile. Si él o ella simplemente desea trabajar para un empleador canadiense, o bajo contrato con una empresa canadiense, la categoría de visitante por negocios no es apropiada.

Transferencia dentro de la compañía

Las disposiciones actuales del CCFTA relacionadas con los transferidos dentro de la empresa son idénticas a las que se encuentran en el NAFTA.

El CCFTA define esta categoria una persona de negocios empleada por una empresa que busca prestar servicios a esa empresa o una subsidiaria o afiliada de la misma, en una capacidad gerencial, ejecutiva o que implica conocimiento especializado, siempre que la empresa la persona cumple con las medidas de inmigración existentes aplicables a la entrada temporal . Los requisitos para esta exención La elegibilidad como trabajador transferido intracompañía requiere evidencia de lo siguiente:
Debe existir una relación calificada entre la empresa canadiense y la empresa ubicada en el extranjero. La organización calificada debe estar activamente “haciendo negocios” tanto en Canadá como en el país del tratado. El término “hacer negocios” significa la provisión regular, sistemática y continua de bienes y / o servicios por parte de una matriz, sucursal, subsidiaria o afiliada en Canadá o Chile, según sea el caso, y no incluye la mera presencia de un agente u oficina en Canadá o Chile. La empresa canadiense debe ser matriz, subsidiaria o afiliada de la empresa ubicada en el extranjero. “Matriz” se define como una empresa, corporación u otra entidad legal que tiene subsidiarias. “Sucursal” se define como una división u oficina operativa de la misma organización alojada en una ubicación diferente. “Filial” se define como una empresa, corporación u otra entidad legal de la cual una controladora posee, directa o indirectamente, más de la mitad de la entidad y controla la entidad; o posee, directa o indirectamente, el 50% de una empresa conjunta 50-50 y tiene el mismo control y poder de veto sobre la entidad; o posee, directa o indirectamente, menos de la mitad de la entidad, pero de hecho controla la entidad.
El trabajador extranjero debe tener al menos un año continuo de empleo con la empresa ubicada en el extranjero dentro del período de tres años anterior a la solicitud de un permiso de trabajo.
El empleo anterior en el extranjero y el empleo propuesto en Canadá deben estar en una capacidad de conocimiento gerencial, ejecutiva o especializada. La definición de “capacidad ejecutiva” requiere que el ejecutivo dirija principalmente la gestión de la organización o un componente o función principal de la misma, establezca metas o políticas relacionadas con ella; ejercer amplia libertad en la toma de decisiones discrecionales; y recibir solo supervisión general de ejecutivos de alto nivel, la junta directiva o los accionistas de la empresa.

La definición de “capacidad gerencial” requiere que el gerente administre la organización, o un departamento, subdivisión, función o componente de la organización; supervisar y controlar el trabajo de otros empleados supervisores, profesionales o gerenciales, o administrar una función esencial dentro de la organización, o un departamento o subdivisión de la organización; tener la autoridad para contratar y despedir o recomendar aquellas y otras acciones del personal (como promoción y autorización de licencia); si ningún otro empleado es supervisado directamente, para funcionar en un nivel superior dentro de la jerarquía de la organización o con respecto a la función administrada; y para ejercer discreción sobre las operaciones diarias de la actividad o función para las cuales el empleado tiene la autoridad.

El “conocimiento especializado” se define como el conocimiento especial que posee una persona del producto, servicio, investigación, equipo, técnicas, administración u otros intereses de la organización solicitante y su aplicación en los mercados internacionales, o un nivel avanzado de conocimiento o experiencia en la organización. procesos y procedimientos.
Las solicitudes de permisos de trabajo como transferidos dentro de la empresa bajo el CCFTA se realizan de manera online, siguiendo el mismo tramite para contrataciones generales bajo CCFTA. Dichos permisos de trabajo pueden otorgarse por un período inicial máximo de hasta tres años. Sin embargo, a las personas admitidas en Canadá para abrir una nueva oficina o para trabajar en una nueva oficina solo se les puede otorgar un período inicial de hasta un año. El ciudadano extranjero puede solicitar extensiones incrementales de tres años.

Inversionistas y traders.

NAFTA (por sus siglas en inglés), es el acuerdo que existe entre México, Estados Unidos y Canadá; mejor conocido como el Tratado de Libre Comercio de Norteamérica (TLCAN), el cual entró en vigor en el año de 1994.

Este tratado se enfoca en crear una zona de libre comercio, con un costo reducido para el intercambio de bienes y servicios, entre los tres países.

NAFTA cuenta con varios capítulos, uno de los cuales provee mecanismos para personas que se encuentren en un apéndice de 60 profesiones seleccionadas, con el fin de entrar al mercado laboral canadiense, de una manera expedita, ya que se le exenta de la LMIA.

Profesionales y técnicos

La categoría de profesionales de CCFTA se otorga a los ciudadanos chilenos que buscan admisión a Canadá para realizar servicios preestablecidos (como un empleado asalariado bajo un contrato personal con un empleador canadiense o mediante un contrato con el empleador del profesional en el país de origen) en nombre de una entidad canadiense a nivel profesional. Solo las profesiones que aparecen en el Apéndice K-03.IV.1 (Ver Listado).

Un extranjero que solicita la admisión como profesional de CCFTA debe cumplir con los requisitos mínimos de credencial para la ocupación propuesta. Estos requisitos de credenciales también aparecen en el Apéndice K-03.IV.1 . Los mismos requisitos que se aplican a las profesiones del TLCAN se mantuvieron y continúan aplicándose en el CCFTA. Sin embargo, los requisitos educativos mínimos y las credenciales alternativas se modificaron para catorce de estas profesiones para reflejar el sistema educativo de Chile.
Además de cumplir con los requisitos educativos mínimos establecidos en el Apéndice K-03.IV.1 , los extranjeros a los que se les otorga la entrada a Canadá como profesionales deben, antes de comenzar su empleo, obtener la licencia, certificación, acreditación o registro profesional necesario aplicable al práctica de su profesión en Canadá.
Las solicitudes de permisos de trabajo para profesionales de CCFTA pueden adjudicarse en un puerto de entrada o realizarse de manera online. Los permisos de trabajo para profesionales de CCFTA se otorgan por un período minimo de un año y máximo de hasta tres años a la vez. Sin embargo, aunque el extranjero debe continuar estableciendo que su entrada es temporal, no hay límite en el número de extensiones disponibles en esta categoría.
